Truck Driver Fines in Germany: Top BAG Violations and What to Watch Out For

BAG is the Federal Office for Goods Transport in Germany. The company has over 1,700 employees. Their main task is to ensure road safety.

Important information for motorists: as of January 1, 2023, BAG will be renamed to BALM (Federal Office for Logistics and Mobility). The name change is due to the expansion of BAG 's mission.

BAG inspectors have the right to stop the cargo-bearing vehicle, inspect the driver and the vehicle, request documents or other information sources to obtain data related to the inspection.

Every year, BAG inspects more than 80,000 foreign trucks and finds some kind of problem in most cases, and about 25% of inspected vehicles are forcibly removed from the road.

Truck drivers often turn to us for help in determining the reasons for the complaints issued by BAG inspectors and, if necessary, for us to quickly carry out mobile repairs on the spot. Based on our many years of experience, we have gathered and listed here the most common violations for which drivers receive a fine during an  inspection. Let’s go through all these in detail.

The most common BAG check violations

  • Working hours. Permitted daily driving time is 9 hours, 10 hours, not more than twice a week. In the course of a year, more than 6,800 foreign truck drivers commit violations to do with non-compliance with schedule rules on routes in Germany. If the driver has exceeded the driving time by 1–2 hours, the fine is 30 euros, then 60 euros for each additional hour.
  • Rest time. On an annual average, more than 11,000 foreign drivers are fined in Germany for non-compliance with rest periods rules. It should be bourne in mind that the driver's daily rest period must be 11 hours; a shortened rest period of 9 hours is permitted no more than three times between two full periods.
  • BAG can and will detect problems with documents. One of the most common problems is that the driver is not registered in the customs system. It is also not uncommon for drivers to be fined for not having a driver card. This is a special smart card that all truck drivers with digital tachographs must use.
  • When checking the general condition of the vehicle, the inspectors from BAG most often find: improper load securing, problems with the technical condition of trailers, unauthorized axle load and total weight exceeding the permissible limit. The German inspection services adhere very strictly to the European Commission's guidelines and principles on load securing and placement! In the event of violations, the driver can be fined from 60 to 480 euros.
  • Manipulation of exhaust emissions. BAG cares not only about road safety, but also about protecting the environment, which is why special attention is paid to checking the permissible noise levels and pollutant emissions. In some cases, a fine of up to 20,000 euros can be imposed.
  • Problems with the technical condition of the vehicle. Most often, inspectors find problems with the brakes, exhaust system and steering. It is not uncommon for drivers to be fined for leaking oil or fuel or for the condition of their tires.

How to behave during a BAG check?

What should you do if you were stopped by BAG inspectors and the above or other violations were found during the checks? Our advice is to always be ready to cooperate, as the escalation of the situation can only lead to an increase in the fine.

Here are some recommendations:

  1. Be courteous in your dialogue with inspectors. Don’t try to 1) make excuses, 2) prove facts, or 3) find another "culprit." This will not work and will only make your situation worse.
  2. Do not admit guilt, either verbally or in writing. If you cannot understand the situation due to a language barrier, contact MT onroad experts.
  3. If possible, take pictures of what happened.
  4. Prepare and present all necessary documents upon request - driver's license, vehicle documents, documents recording hours of work and rest, documents for the cargo. Inspectors may also ask for special load securing reports (e.g. certificate according to DIN EN 12642 XL regulations).
  5. If there is a fine, it is better to pay immediately. You should get a receipt. This will settle the issue and there will be no further escalation.
  6. You cannot pay in cash! In this case, misdemeanor proceedings will be initiated against all parties involved.

Truck driver fines for speeding in Germany depend on where exactly the violation took place — within city limits or outside them. Below are the fine amounts based on how much the permitted speed limit for trucks was exceeded in 2025:

Case: BAG control and mobile tire service
